Terms of Sale and Use

Who you are contracting with

SkyRaun is owned and operated by Spensr LLC ("Spensr", "we", "us"), a limited liability company organised under the laws of the State of Florida, United States, Florida Division of Corporations document number L25000235436, with its principal address at 7901 4th St N, Ste 300, St. Petersburg, FL 33702.

"You" means the individual making the purchase. If you are buying on behalf of an employer, you confirm you have authority to bind them, and the one-licence-per-person rule in clause 3 applies.

What you are buying

SkyRaun Foundations is a one-time purchase that gives you:

• Access to a private Git repository containing the curriculum, runnable systems, starter code, solutions, experiments and incident challenges as they exist at the time of purchase;
• Updates to the Foundations track for as long as that track is actively maintained, delivered through the same repository;
• An invitation to the private SkyRaun community.

The status of individual modules is published on the curriculum page and is stated honestly: sixteen lessons are shipped and runnable, and the capstone is planned and included when it releases. You are buying what is shipped at the time you purchase, plus whatever is added while the track is maintained. Planned modules are an intention, not a commitment, and no specific future module forms part of this agreement.

Your licence

We grant you a personal, worldwide, non-exclusive, non-transferable, non-sublicensable licence to use the materials for your own learning and for your own professional work, including work you do for an employer or client.

You may:

• Clone the repository as many times as you like, on as many of your own machines as you like;
• Modify the code and lessons locally for your own use;
• Apply anything you learn in commercial work, without attribution or royalty;
• Quote short excerpts publicly with attribution, for example in a blog post or conference talk.

You may not:

• Republish, redistribute, mirror, resell or sublicense the materials, in whole or in substantial part;
• Share your repository access, your invitation, or the repository contents with anyone else;
• Post the materials to a public repository, file host, torrent or archive;
• Use the materials to build, train or populate a competing course, bootcamp or training product;
• Remove or obscure copyright notices.

One licence covers one person. If you want your team to use SkyRaun, buy one licence per person. We would rather sell you five licences than discover a shared account.

All intellectual property in the materials remains with Spensr LLC. Nothing here transfers ownership.

A copy of this licence is included in the repository as the LICENSE file. If the LICENSE file and this clause ever differ, this clause governs for purchases made under these terms.

What "permanent access" means

We say "the materials stay yours" and we mean something specific by it, so here it is precisely.

• What is permanent: once you have cloned the repository, that copy is yours. It works offline, with no login, no licence check and no dependency on anything of ours staying online. If Spensr LLC ceased trading tomorrow, your clone would keep working.
• What is not permanent: hosted access to the repository itself. We intend to keep it available indefinitely, but we do not guarantee that GitHub, or we, will exist forever. Clone it. Do not treat our repository as your backup.
• Updates: included for as long as the Foundations track is actively maintained. We deliberately do not promise "lifetime updates", because nobody can honestly sell that. If we stop maintaining the track we will say so, and you keep everything published up to that point.

Repository access

Access is granted by adding the GitHub account you nominate at checkout as a read-only collaborator on a private repository. You are responsible for giving us the correct username and for the security of that account.

The invitation is sent automatically by our payment webhook, normally within about a minute of Stripe confirming your payment. If the automatic invitation fails, we fix it by hand. If you have not received an invitation within two business days, contact us.

We may revoke access without refund if we find credible evidence that you have shared, republished or resold the materials in breach of clause 3.

The community

The SkyRaun community is hosted on Discord, which is a third-party service with its own terms and privacy policy. Your use of Discord is between you and Discord.

Community access is a benefit of purchase, not a support contract. Specifically, there is no guaranteed response time, no guaranteed participation by the creator, no scheduled office hours and no one-to-one mentoring. This is stated on the community page as well, deliberately.

We may remove anyone from the community for harassment, spam, posting paid materials publicly, or persistently degrading the space for others. Removal from the community does not affect your repository access or entitle you to a refund, and vice versa.

Price, tax and payment

Prices are shown in US dollars and are exclusive of any sales tax, VAT or GST unless stated otherwise at checkout. Where we are required to collect such taxes, they are added at checkout and shown before you pay.

Payment is processed by Stripe. We never see or store your card details. Your relationship with Stripe for the payment itself is governed by Stripe's own terms.

We may change the price of future purchases at any time. A price change never affects a purchase already made.

Refunds and withdrawal rights

Our policy. If SkyRaun is not what you expected, email us within 14 days of purchase and we will refund you in full, provided you have not yet accepted the repository invitation. Once you have accepted the invitation you have the complete product on your machine, and it cannot meaningfully be returned.

After that point refunds are at our discretion. We would rather refund someone who is unhappy than argue with them, but the honest position is that we cannot un-deliver a repository you have cloned.

If we refund you. A refund ends the purchase: we revoke the repository invitation or access, we remove your community access, and the licence in clause 3 ends for the refunded purchase.

Chargebacks. If you dispute a charge with your card issuer instead of contacting us, we may suspend your access while the dispute is open, and we will revoke it if the dispute is resolved against the payment.

Before you buy, Lab 01 is published free in full so you can judge the writing and the approach at no risk. Please read it first.

Consumers in the EEA and UK. You normally have a 14-day right to withdraw from a purchase of digital content. That right is lost once supply has begun with your express consent. By ticking the agreement box at checkout and completing your purchase, you expressly request that we begin supplying the digital content immediately and you acknowledge that you will lose your right of withdrawal once you accept the repository invitation. Until you accept the invitation, your statutory right is unaffected. To withdraw, email info@spensr.io stating that you withdraw from your purchase.

Emails we send you

There are three distinct categories, and you control two of them.

• a) Transactional — not optional. Most of these do not come from us directly: Stripe emails your payment receipt, GitHub notifies you of your repository invitation, and the purchase confirmation page shows your access status and the Discord invite. We do not send a separate access email. Directly from us you may receive replies to your support requests, security notices, and notice of material changes to these terms or to your access. All of these are necessary to perform our contract with you and are not marketing. You cannot opt out of them while you hold access, because they are how we tell you things you need to know.
• b) Product updates — opt-in. News about SkyRaun Foundations itself: new labs, new modules, significant corrections, changes to how the workspace runs. Sent only if you ticked that box at checkout or subscribed later.
• c) New products and offerings — opt-in, separate. Marketing about other products, courses and services from Spensr LLC, including future SkyRaun tracks, launches, pricing offers and promotions. Sent only if you ticked that box. This is a separate consent from (b) and ticking one never implies the other.

Neither optional consent is a condition of purchase, and no box is pre-ticked. You can withdraw either consent at any time using the unsubscribe link in any such email or by emailing info@spensr.io. Withdrawing marketing consent has no effect whatsoever on your repository access, your community access, or your rights under these terms.

We do not sell, rent or share your email address with other companies for their marketing.

SkyRaun Live

"SkyRaun Live" refers to a possible future hosted laboratory service. It is exploratory. It is not part of what you are buying, it has no launch date, and it may never exist.

If it does launch, we intend to give Foundations purchasers a complimentary period of access. That is a statement of intent and creates no obligation. Nothing in Foundations requires Live in order to work, now or later.

Running the labs on your own machine

SkyRaun is a hands-on laboratory. The labs start network listeners on localhost, run containers, inject faults, terminate processes and manipulate local network behaviour. That is the entire point of the product.

You run all of it on your own hardware, on your own responsibility. Read a lab before you run it. Do not run these labs against systems you do not own or are not authorised to test, against your employer's production infrastructure, or on a machine where an unexpected process or port binding would cause a problem.

Some later labs may use paid third-party cloud services. Where that is the case the lab says so up front, including that it may cost you money. Any such charges are between you and that provider.

Acceptable use

Do not attempt to gain unauthorised access to our systems, scrape the site at a rate that degrades it for others, resell access, or use SkyRaun in violation of applicable law or export controls.

No warranty

The materials are provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Specifically, and to be plain about it: SkyRaun is educational material. We do not promise that it will get you a job, a promotion, a pay rise, or a passing grade in an interview. We do not warrant that the materials are free of errors, that every lab will run identically on every machine, or that the curriculum is complete. It is a laboratory built by a working engineer, published honestly, including its gaps.

Limitation of liability

To the fullest extent permitted by law, Spensr LLC's total aggregate liability arising out of or relating to SkyRaun is limited to the amount you actually paid us.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, lost revenue or business interruption, however caused.

Nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, in which case the exclusions apply only to the extent permitted.

Termination

You may stop using SkyRaun at any time. We may terminate your access for a material breach of clause 3 or clause 12, ordinarily after telling you what the problem is and giving you a chance to fix it, unless the breach is deliberate redistribution.

Clauses 3, 13, 14 and 16 survive termination. A clone already on your machine is not affected by termination of hosted access, except that the licence restrictions in clause 3 continue to apply to it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. The state and federal courts located in Florida have exclusive jurisdiction, except that consumers may bring proceedings in their country of residence where local law gives them that right.

Privacy, analytics and advertising

How we handle personal data — including website analytics, advertising pixels and conversion measurement — is described in the Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms for future purchases. The version in force for your purchase is the one displayed at checkout when you bought, and the version number is recorded against your transaction. Changes are never applied retroactively to a purchase already made.
